Terms/Conditions: Any agent interested in utilizing Listing Assistant service must consent to our terms and conditions. Terms/Conditions::limitation of liability in no event shall listing assistant llc and/or its suppliers be liable for any personal injury sustained through your use of this service, or any information, software, products, and services obtained through this website, or through contact with the consumers set forth in the leads, or otherwise arising out of the use of this website. in no event shall listing assistant and/or its suppliers be liable for any indirect, punitive, incidental, special, exemplary, consequential, or other damages (including without limitation damages for loss of interruption of business, loss of profits, loss of revenue, loss of services, loss of data, or loss of goodwill) arising out of or in any way connected with the use of this website or with the delay or inability to use this website, or with any information, software, products, or services obtained through this website, or otherwise arising out of the use of this website, whether based on contract, tort, negligence, strict liability, or otherwise, even if listing assistant and/or any of its suppliers have been advised of the possibility of damages. in no event will listing assistant llc aggregate liability in connection with this website, or any information, software, products, or services obtained through this website, or otherwise arising out of the use of this website, exceed the fees actually paid to listing assistant llc by the agent for the leads immediately prior to the cause of action giving rise to such damages. the foregoing limitations shall apply even if the above stated remedy fails of its essential purpose. you acknowledge that the limitations of liability in these terms & conditions and the allocation of risk herein are an essential element of the bargain between the parties, without which listing assistant llc would not have provided services to the consumer. listing assistant llc pricing reflects this allocation of risk and the limitation of liability specified herein. term of service i understand that listing assistant llc will market to homeowners on my behalf to my desired area up to 40 miles. i understand that listing assistant llc does not guarantee sales by utilizing their service. I understand that I must conduct my own due diligence of each lead given before contacting the homeowner. I understand that the service rendered is for the use of gathering information of homeowners looking to receive offers, value reports, or any interest in selling in the near future. I understand that a listing assistant may use third party sources to gather lead information and or use cold contact solicitation. I understand I must market myself to the best of my ability to convert given leads to sales. i understand that the service payments are used for marketing and time rendered towards gathering lead information ( i.e calling, texting, emailing,etc). I understand that no refunds or chargebacks will be granted. I understand that I must introduce myself to the homeowners within 3 hours of receiving a lead. I understand that I must present myself as a knowledgeable agent that has a client first attitude. user indemnity. you agree to defend, indemnify, and hold harmless and its affiliates, officers, directors, employees, and consultants, from and against any and all claims, losses, liabilities, and damages of any kind resulting from: (1) your failure to comply with these terms & conditions; (2) your use of the website or any information disclosed therein; (3) your negligence and/or intentional misconduct; (4) breach of any representation, warranty or obligation hereunder and/or (4) any authorized disclosure of personal information (including, without limitation, your authorization that disclose your personal information to homeowners. proprietary rights; no resale of serviceslisting assistant llc has invested a significant amount of time, effort, and resources in the creation of this website.
